Immigration Bond
When a person is detained by U.S. Immigration and Customs Enforcement (ICE), they may be eligible to request an immigration bond hearing. A bond hearing gives an Immigration Judge the opportunity to determine whether the individual can be released from detention while their immigration case is pending.
The Immigration Judge considers several factors when deciding whether to grant bond, with the primary focus on:
- Whether the individual poses a danger to the community.
- Whether the individual is likely to appear for all future immigration court hearings.
To make this determination, the Judge reviews evidence presented by both the individual and the government. Favorable evidence may include:
- Proof of employment
- Strong family and community ties
- A stable residence
- Letters of support from family members, employers, religious leaders, or community members
- Evidence of good moral character and community involvement
- A limited or nonexistent criminal history
The Judge may also consider any criminal convictions, prior immigration violations, or previous failures to appear in court.
Preparing a Strong Bond Packet
A well-prepared bond packet is one of the most important parts of a successful bond hearing. A comprehensive bond packet helps demonstrate that the individual is a responsible member of the community who will comply with all court requirements if released.
Supporting documentation may include:
- A legal memorandum
- Employment verification
- Proof of residence
- Tax returns or pay records
- Letters of support
- Family records
- Other evidence showing community ties, financial stability, and good character
Presenting organized, persuasive evidence can make a meaningful difference in the Immigration Judge’s decision.
Requesting an Immigration Bond Hearing
If an individual is eligible for bond, they or their attorney may request a bond hearing before an Immigration Judge. Depending on the circumstances, either ICE or the Immigration Judge will determine whether bond is available and, if appropriate, the amount of the bond.
During the hearing, both the individual (or their attorney) and the government have the opportunity to present evidence and legal arguments. After reviewing the evidence, the Immigration Judge will decide whether to grant bond and, if so, set the bond amount.
Every immigration bond case is unique. The outcome depends on the specific facts of the case and the strength of the evidence presented. Preparing a complete and compelling bond packet can significantly improve the likelihood of obtaining release while immigration proceedings are pending.
